KINKYFANS TERMS OF USE

1. Introduction

1.1 These Terms of Use ("Agreement") govern the relationship between KinkyFans and all users of the platform, including but not limited to content creators ("Creators") and subscribers ("Fans").

1.2 By accessing or using KinkyFans, you agree to comply with and be legally bound by these Terms of Use. If you do not agree with any provision herein, you must cease using the platform immediately.

 

2. Definitions and Interpretation

For the purposes of this Agreement:

2.1 "KinkyFans" refers to the platform and its services, accessible through any designated URL.

2.2 "Operator," "we," "us," or "our" refers to the legal entity responsible for operating KinkyFans.

2.3 "User" refers to any individual utilizing the KinkyFans platform, whether as a Creator, Fan, or both.

2.4 "Content" means any material uploaded, shared, or transmitted via KinkyFans, including but not limited to videos, images, audio files, live-streamed content, metadata, text, GIFs, memes, and interactive elements.

2.5 "Creator" refers to a User who has established an account for the purpose of publishing content that is viewable by other Users.

2.6 "Fan" refers to a User who subscribes to or views a Creator’s content.

 

3. Changes to the Terms of Use

3.1 KinkyFans reserves the right to modify or amend these Terms of Use at its sole discretion.

3.2 Any material changes will be communicated to Users via email or platform notifications. Continued use of KinkyFans following such amendments constitutes acceptance of the updated Terms.

 

4. User Registration and Eligibility

4.1 To use KinkyFans, Users must:
(a) be at least 18 years old (or the legal age of majority in their jurisdiction);
(b) create an account using valid and truthful personal information; and
(c) comply with all applicable laws and regulations.

4.2 Users agree not to impersonate any individual or entity or provide false information during registration.

 

5. Obligations of Fans

5.1 Fans must ensure that:
(a) their interactions on the platform comply with all legal and ethical standards;
(b) they do not attempt to share, distribute, or record content without explicit permission from the Creator; and
(c) all payment obligations are fulfilled in accordance with the platform’s payment policies.

 

6. Subscription and Payment Terms

6.1 Fans may subscribe to Creators under terms specified by each Creator.

6.2 Subscription payments are non-refundable unless required by law.

6.3 Subscription renewals are automatic unless canceled prior to the renewal date.

6.4 In the event of a dispute concerning a transaction, KinkyFans reserves the right to investigate and resolve the issue at its sole discretion.

 

7. Acceptable Use Policy

7.1 Users may only use KinkyFans for personal and lawful purposes.

7.2 The following conduct is strictly prohibited:
(a) uploading or sharing illegal, defamatory, fraudulent, hateful, or discriminatory content;
(b) exploitation or endangerment of minors in any form;
(c) infringement of copyright or other intellectual property rights;
(d) engaging in misleading or deceptive practices;
(e) uploading or transmitting harmful software or malware;
(f) violating the privacy rights of others; and
(g) engaging in harassment, threats, or intimidation against any User.

7.3 Any violation of this policy may result in account suspension or termination without prior notice.

 

8. Content Moderation and Compliance

8.1 All uploaded content is subject to review to ensure compliance with platform policies and applicable laws.

8.2 KinkyFans reserves the right to remove any content that violates these Terms or applicable laws.

8.3 The Operator has engaged legal counsel to review and escalate any violations to appropriate authorities when necessary.

 

9. Responsibilities of Content Creators

9.1 Creators acknowledge and agree that:
(a) they are solely responsible for the content they upload;
(b) they must obtain written consent from all individuals depicted in their content, including consent for public distribution and potential downloads;
(c) they must verify the identity and age (18+) of all individuals appearing in their content and maintain supporting documentation for compliance purposes;
(d) they may not upload content that depicts blood, violence, weapons, illegal substances, or non-consensual activities.

9.2 KinkyFans imposes a 20% platform service fee on all Creator earnings.

 

10. Intellectual Property Rights

10.1 Users retain ownership of content uploaded to KinkyFans but grant the platform a limited, non-exclusive, royalty-free license to host and display the content.

10.2 Users must not upload or distribute content for which they do not hold the necessary rights.

10.3 Any unauthorized use of copyrighted material will result in immediate removal and possible legal action.

 

11. Account Termination and Suspension

11.1 KinkyFans reserves the right to terminate or suspend accounts in the event of:
(a) violation of these Terms;
(b) illegal or fraudulent activity;
(c) repeated user complaints; or
(d) failure to comply with payment obligations.

11.2 Suspended accounts may be subject to a review process, and affected Users may appeal the decision.

 

12. Complaints and Content Removal Procedures

12.1 Users may submit complaints via email to Support.

12.2 Complaints will be reviewed within 7 business days, and appropriate actions, including content removal, may be taken.

12.3 If a User objects to the publication of certain content in which they are depicted, they may request its removal by contacting Support.

12.4 KinkyFans reserves the right to permanently remove any content that violates these Terms or legal regulations without prior notice.

12.5 Users whose content has been removed may appeal the decision through a formal appeals process outlined separately.

 

13. Legal and Compliance Obligations

13.1 Content uploaded without the proper consent or legal verification is strictly prohibited.

13.2 Any Creator found uploading content without consent from all depicted individuals may be subject to legal action and permanent account suspension.

13.3 KinkyFans fully complies with applicable laws concerning privacy, age verification, and content moderation and will cooperate with law enforcement authorities where required.

 

14. Limitation of Liability

14.1 KinkyFans shall not be liable for:
(a) any loss or damage resulting from the use of the platform;
(b) content uploaded by third parties;
(c) unauthorized access to User accounts or data breaches beyond reasonable control.

14.2 Users agree to indemnify and hold KinkyFans harmless against any legal claims arising from their use of the platform.

 

15. Governing Law and Jurisdiction

15.1 These Terms of Use shall be governed by and construed in accordance with the laws of Liechtenstein.

15.2 Any disputes arising from these Terms shall be resolved exclusively in the courts of Liechtenstein, unless otherwise required by applicable consumer protection laws.
